법률 의견서를 작성하기 전에는 다음 사항을 파악해야 한다.
- 의뢰인의 필요나 성향 파악함(실무자와의 연락은 누구와 언제하나?)
- 서면의 형식(정식 의견서인가, Memorandum 형식, 전자우편)
- 문투 결정(비용부담과 시급성)등을 고려하여 결정한다.
- 사안(검토의 배경)에 대한 정확한 파악
- 충분한 문헌조사
- 결론과 논거에 대한 팀 내 사전 협의(해결책과 로드맵 제시가 가능한가?)
구체적 얼개[+/-]
- 전체 글의 구도 잡기
- 기본구도: IRAC(다양한 변용 가능)
- 적절한 분량(전체 및 각 쟁점별)에 대한 사전 예측
- 법령과 법리에 관한 서숱 정도 - 의뢰인의 수준을 고려하되 단 이해하기 쉽게
- 샘플에 따른 Letterhead/ 제목을 어떻게 적을 것인가?
- 사실관계(사안의 개요/검토의 베경)의 정리는 왜 하는가? 어디까지 하는가? 무엇을 빠트리면 안 되는가? 세부 사실관계는 분석 부분에 포함하는 것이 효율적일 수 있음
- 이해관계인(개인/법인/단체)의 표시 방법：지위나 약어로 표시하는 것이 적절한 경우 많음
- ‘질의 요지’의 정리 필요성/기준/말미 문구
- 품사의 통일

- 주술관계(단, 착문의 구조 이해농 . 하나의 wmenee 속에 六何의 문구톨 어면 순서로 배치하여야 하는가?

- 괄호 사용/각주 사용/따음표/콤마 사용의 기준 및 방식 . 위하여/위해서 — 대하여/대해서
- 겉으로 보기에 품격이 있는가(Make it 100k good)? (의견서의 외모느 목차/밑즐 /bold/각주/줄간격， 글자크기(이메일에서)/문단 구분/페이지 말미의 위치
- 적절한 Tone 의 사용
- 쟁점에 대한 당신의 의견은 도대체 무엇인가?
- 무엇을， 어떻게， 언제 할 것을 권고하고 있는가?-Solution/Roadmap에 대한 의견이 담겨 있는지 재확인
